To Provide for the Establishment of a Sick Leave Reserve Fund

  1. Pursuant to Section 56 (2) of the Health Protection and Promotion Act, the Board of Health may pass a bylaw on any other matter necessary or advisable for the management of the affairs of the Board of Health.; and,
    1. Pursuant to section 417 (1) of the Municipal Act, the Board of Health may establish a discretionary reserve fund.
  2. In this bylaw;
    1. "Board" means the Board of Health for the Simcoe Muskoka District Health Unit.
    2. Health Unit means Simcoe Muskoka District Health Unit.
    3. MOH means Medical Officer of Health.
    4. SCDHU means Simcoe County District Health Unit
  3. The Board authorizes the establishment of a reserve fund to provide for:
    1. The municipal share of the unpaid balance of the sick leave credits owed to non-union employees who were employed by the SCDHU accrued sick leave benefit plan in existence on or before March 1, 1981; and,
    2. The municipal share of the unpaid balance of the sick leave credits owed to the members of the Ontario Nurses’ Association who were employed by the SCDHU on or before November 1, 1988 .
  4. These employees are entitled to a payout of one-half of their accrued sick leave balance as defined in 4 a) or b) upon their termination with the Health Unit.
  5. This reserve fund is to be accounted for separately in the General Ledger of the Health Unit and is subject to a yearly audit.

By-law 2005-10 read a first, second and third time and finally passed this 1st day of April, 2005.
