In May of 2014 the new Skin Cancer Prevention Act came into effect. Tanning operators are required to notify the Health Unit of new or existing businesses.
The Act and its corresponding regulation require that operators of tanning beds:
- Do not offer tanning services to youth under 18 years of age
- Post required signage (4 signs)
- ID all individuals who appear to be less than 25 years of age
- Do not market/advertise tanning services to anyone less than 18 years of age
- Provide a trained attendant to oversee/operate the timing device
- Provide protective eye wear for clients

The Health Unit’s role under this legislation is to conduct:
- Educational based inspections (upon notification of operation)
- Complaints based inspections (assessing compliance with the above noted requirements in the facility)

Point of Sale Warning Sign
- Must be displayed within 1 metre of each cash register where tanning services or ultraviolet light treatments for tanning are offered.
- Must be unobstructed and readily legible to individuals before they use the equipment.
Health Warning Sign
- Must be displayed within 1 metre of each piece of equipment used to provide tanning services or ultraviolet light treatments for tanning.
- Must be unobstructed and readily legible to individuals before they use the equipment.
Age Restriction and Identification Decals
- Must be placed immediately above or in close proximity to the handle on every entrance door of the establishment where the treatments or services are provided.
- If the entrance door does not have a handle, the decal must be placed in the middle of the door.
- The sign must be posted in a manner that is unobstructed and readily legible to individuals who are approaching the establishment.
Employee Reminder Decals
- Must be unobstructed and readily legible to staff working at points of sale.
